LGBT Couples and Family Law
Northern Virginia Family Law Attorneys Helping the Lesbian, Gay, Bi-Sexual, and Transgender (LGBT) Community with Family Law
Despite the fact that Constitution of Virginia and statutes still prohibit same-sex marriages in Virginia, Virginia has recognized same-sex marriages and allowed same-sex couples to get married since October 6, 2014. By refusing to hear the case of Bostic v. Schaefer, the Supreme Court of the United States allowed a lower court ruling to stand that invalidated the 2006 amendment to the Virginia Constitution defining a marriage between a man and a woman.
On June 26, 2015 in Obergefell v. Hodges the Supreme Court of the United States went one step further and required all states to recognize same-sex marriages performed in all states and territories of the United States and to issue marriage licenses to same-sex couples. With these Supreme Court rulings, family law in Virginia has transformed from a minefield for same-sex partners into a level playing surface where all individuals are treated the same under the law no matter their gender or sexual preference.

These rulings have broken through to make family considerably more equal for same-sex couples. This is a milestone for the United States that was a long time coming, but unfortunately, same-sex couples are susceptible to the same inter-familial hardships and disputes as heterosexual couples.
