Child Support
Under Virginia law both parents are responsible for the financial support of their minor children. Virginia provides guidelines for computing the basic monthly amount of child support obligation, which is based on:
- Combined monthly gross incomes of the two parents
- Number of children
- Percentage of time the children physically reside with each parent
The support obligation may be modified based on the cost of work-related child care, health care coverage, and extraordinary medical and dental expenses. The total support obligation is allocated between the parents proportionately to their monthly gross incomes. A court may deviate from the statutory guideline amount if that amount would be unjust or inappropriate in the particular case.
Child support is normally payable until a child attains age 18. However, Virginia courts are required to order continued support for a child over 18 who is a full-time high school student, not self-supporting, and living in the home of the parent seeking or receiving child support, until the child reaches 19 or graduates from high school, whichever comes first.
The court may also order continued support for any child over 18 who is severely and permanently mentally or physically disabled, unable to live independently and support himself, and who resides in the home of the parent seeking or receiving support.
